1. Acceptance of Terms
By downloading, installing, or using EasyWidge ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.
2. Description of the Software
EasyWidge is a free, open-source desktop weather widget application that displays current weather conditions for user-configured cities. The Software is distributed under the GNU Affero General Public License v3.0 (AGPL-3.0).
3. License Grant
Subject to the terms of the AGPL-3.0 license, you are granted a worldwide, royalty-free, non-exclusive license to use, copy, modify, and distribute the Software. The full terms of the AGPL-3.0 license govern your use and take precedence over these Terms in case of any conflict regarding software licensing.
4. User Responsibilities
When using EasyWidge, you agree to:
- Comply with the terms of the AGPL-3.0 license.
- Obtain and manage your own API keys for third-party weather services (e.g., OpenWeatherMap).
- Comply with the terms of service of any third-party weather API provider you use.
- Keep your API keys secure and not share them publicly.
- Use the Software in compliance with all applicable local, state, national, and international laws.
5. Third-Party Services
EasyWidge can be configured to retrieve weather data from third-party API providers. These services are operated independently and are not affiliated with EasyWidge.
- We are not responsible for the availability, accuracy, or reliability of third-party weather data.
- Your use of third-party APIs is subject to their respective terms of service and privacy policies.
- API rate limits, pricing changes, or service discontinuation by third-party providers are outside our control.
6. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Specifically, we do not warrant that:
- The Software will be error-free or uninterrupted.
- Weather data displayed will be accurate, complete, or current.
- The Software will be compatible with all systems or configurations.
- Defects in the Software will be corrected in any specific timeframe.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE AUTHORS, CONTRIBUTORS, OR COPYRIGHT HOLDERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. Weather Data Accuracy
EasyWidge displays weather information obtained from third-party sources. This data is provided for informational purposes only and should not be relied upon for critical decisions. Always consult official weather services for severe weather warnings and safety-critical information.
9. Modifications to the Software
As open-source software, EasyWidge may be modified by anyone under the terms of the AGPL-3.0 license. The original authors are not responsible for any modifications made by third parties. If you use a modified version, the modifier bears responsibility for those changes.
10. Contributions
If you contribute code, documentation, or other materials to EasyWidge, you agree that:
- Your contributions will be licensed under the AGPL-3.0 license.
- You have the right to submit the contribution and grant this license.
- Your contribution does not infringe on any third-party intellectual property rights.
11. Termination
These Terms are effective until terminated. Your rights under these Terms will terminate automatically if you fail to comply with any of the terms. Upon termination, you must cease all use of the Software and destroy any copies in your possession.
The AGPL-3.0 license terms regarding termination and reinstatement (Sections 8 and 9 of the AGPL-3.0) also apply.
12. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the Software after changes constitutes acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable open-source software laws and the terms of the AGPL-3.0 license. Any disputes arising from these Terms shall be resolved through the issue tracker on the project's GitHub repository when possible.
